GENERAL SALES CONDITIONS
Article 1: General dispositions
These General Sales Conditions apply to individual bookings of 5 rooms or less, made in one go, concluded directly in the Grand Hotel Abbatiale (further on the Hotel) or on the website www. grandhotelbenodet.fr.
The customer is engaged to respect and to make respect all the dispositions announced in this document, as well as legal and regulatory requirements.
These General Sales Conditions will prevail over any other general sales conditions not expressively approved by the Hotel.
Article 2: Capacity
The client acknowledges that he has the capacity to contract, which is to say to have the legal majority and not to be under curatorship or under tutelage (18 years).
Article 3: Reservation
The rates are established in euros (€) per room and per night in an “all taxes included” price.
City tax is not included and is payable at the Hotel.
Any modification or introduction of new legal or regulatory tax imposed by the competent authorities will automatically be reflected on the prices indicated at the date of invoicing.
Unless stated otherwise, additional services (breakfast, half board etc.) are not included in the price.
Rates are subject to change without prior notice and only the price mentioned in the booking confirmation is contractual.
Article 4: Guarantee.
The reservation will be effective only if the customer guarantees his reservation by communicating a credit or debit card number with date of validity, still valid at the time of the stay of the customer. The Hotel reserves the right to refuse any booking in case the card number is incorrect or the reservation is incomplete.
At the moment of booking, a debit pre-authorization of the bank card will be made. This will be done for informational purposes, and under no circumstances will be a debit of the account. Payment is to be done in full disregarding the amount of the authorization. The pre-authorization amount is automatically refunded after the full payment.
Article 5: Payment terms
The payment for all the services included in the reservation is to be made directly at the Hotel, with the exception of reservations pre-paid at the moment of booking.
The following payment methods are accepted: credit or debit bank cards, cards American Express, cash.
Article 6: Room availability
The rooms are available from 3 p.m. on the day of arrival and must be vacated by 12 noon on the day of departure.
Upon the customer’s request, a departure at 2 p.m. maximum can be granted at the additional fee. Any departure after 2 p.m. is charged as an additional night.
Article 7: Hotel stay
In accordance with French legislation, upon his arrival at the Hotel, the client will be asked to present an identity card in order to verify his origin.
The customer engages to use the room as a reasonable man. Any behavior contrary to good morals and public order will force the hotelier to ask the customer to leave the establishment without any compensation and without any refund if a payment has already been done.
The customer undertakes not to invite anybody whose behavior is likely to jeopardize the establishment, the hotelier reserves the right to intervene if necessary.
It is forbidden to smoke in all the premises of the Hotel.
Pets are allowed but on conditions: not be left at liberty in common areas of the property. Basket or box or cage is compulsory for sleeping. It is forbidden to allow pets to get onto the furniture. For the reasons of hygiene, pets are not allowed in the breakfast room.
Article 8: Terms of cancelation
No fee will be charged if the reservation is canceled 2 days before the arrival date, before 6pm local time. Past this period, the first night will be charged.
The date of reception of the cancellation request (by e-mail, mail, and telephone) is the one that will be taken into consideration for the effective cancellation of the reservation.
In case of no show and in absence of cancellation, the customer will be charged the amount of the first night.
Prepaid reservations are not subject to change or cancellation. The sums paid as an advance will not be the subject to any refund.
In case of interruption of the stay (unexpected departure) and in the case of an on-site reservation, the customer who did not inform the Hotel 24hrs before his departure, must also pay the night of the day of his departure. In the case of prepaid reservation, no refund will be made.
In application of Article L.221-28 and L.221-5 of the Consumer Code, no right of withdrawal applies to accommodation and / or catering services which must be provided at a determined date or with determined periodicity.
Article 9: Dislodgement
In case of force majeure, exceptional event or technical or organizational problems in the Hotel, that make it impossible for the client to stay, the Hotel will make every effort to find alternative accommodation in a hotel of the same category if possible or higher category. Expenses of dislodgement (extra charge) will be borne by the Hotel except for case of force majeure. Are considered as cases of force majeure or fortuitous event those recognized as such by the jurisprudence of the French Courts.
Article 10: Complaints

15 days at the latest after the date of departure. After this deadline, no claim can be taken into account.
Article 11: Responsibilities
The Hotel declines any responsibility in case of theft, loss, degradation of the belongings of it’s customers during their stay.
The customer shall be held responsible for any damage, degradation or any act of vandalism which may occur as a result of the occupancy of the premises and / or the deeds of persons for whom he is responsible, movable, decorative and immovable property belonging or not to the hotel. Le client sera tenu pour responsable de tout dommage, de toute dégradation, de tout acte de vandalisme qui pourrait survenir du fait de l’occupation des locaux et/ou du fait des participants et/ou du personnel dont il a la charge, tant aux biens mobiliers, de décoration et immobiliers appartenant ou non à l’hôtel.
As far as the online reservation process on the website www.grandhotelbenodet.fr is concerned, the Hotel cannot be held responsible for any damage resulting from the use of the Internet network such as data loss, virus, service breakdown etc.
Article 12: Data processing and freedoms
In accordance with Law 78-17, known as data processing and freedoms, customers are advised that their reservation is subject to a computerized nominative treatment. Users have the right to access and rectify the data entered, which is exercised at the registered office of the company. The client agrees to be part of the Hotel’s customer file. It is specified that this information is not communicated to third parties.
The information requested from the customer is necessary to process his reservation order and to send him information about the products and services of the Grand Hôtel Abbatiale. It will be communicated to the Hotel, its entities, the technical services provider in sake of the reservation. In the absence of this information, the Hotel would not be able to register the reservation.
Unless the customer objects, the Hotel is likely to send him by e-mail it’s newsletters, promotional offers, a pre-check questionnaire, and a post-stay survey.
Article 13: Intellectual property
Concerning the use of the website www.grandhotelbenodet.fr, Odet LTD holds all the intellectual property rights related to the site.
The elements accessible on the site, in the form of texts, photographs, images, sound icons, videos, software, databases, are also protected by intellectual and industrial property rights and other privative rights held by Odet LTD.
Except a special agreement in writing by Odet LTD, it is expressly forbidden to reproduce, exploit, distribute or use for any reason whatsoever, even partially, the elements present on the site, or to broadcast a simple hypertext link.
Article 14: Assignment of jurisdiction
Any disputes that may occur out of the application or interpretation of these general sales conditions will be governed by French law and will fall within the exclusive jurisdiction of the French courts, namely within the jurisdiction of the Court of Appeal of Rennes.
Article 15: Evolution / modification of the general sales conditions
These general sales conditions are subject to change at any time and the conditions applicable will be those in force on the date of the reservation.
